These Terms of Service ("Terms") govern your use of Aeris ("the Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using Aeris, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Aeris provides Field service management for HVAC contractors.. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify or discontinue features at any time with reasonable notice.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

4. Subscription and Billing

The Service is offered on a subscription basis. Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for the subscription fees. Fees are non-refundable except as required by law.

5. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. After cancellation, your data will be retained for 30 days to allow for export, then permanently deleted.

You retain all ownership rights to data you enter into Aeris. We act as a data processor for your data. You grant us a license to use your data solely to provide, maintain, and improve the Service.

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Aeris shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.
